RG 1: Models of criminal imputation and behavioural sciences – Knowledge of the person in Philosophy and in the Sciences and criminal liability

Line of research objectives

• Contributing to the critical deconstruction and reconstruction of some aspects of the language of Criminal Law and some of its traditional criteria of liability, with impacts within the framework of producing legislation and of judicial decisions (critical analysis of the legislative decision-making methods and of the grounds for criminal decisions), from both the substantive and the procedural perspective;
• Promoting an understanding within other behavioural sciences of the practical sense and efficacy of Criminal Law concepts and criteria. Satisfying the information needs of Criminal Law regarding the criteria for analysing and defining the objectivity of the facts offered by the sciences (the logic of causation, of intentionality, of defining the possibilities and alternatives for action, of risk and hazards);
• Establishing a logic of reciprocity between Criminal Law and the sciences so that research, both in Criminal Law and in the behavioural sciences, may be built on scientific bases which enable dialogue and cross-referencing when defining the facts which constitute the respective object of knowledge and analysis.

• Philosophy of Science, Technology, Arts and Society (theory of Justice and the problem of truth)
  To be carried out by: Group I
  Method: Participation in the multidisciplinary PhD course in collaboration with the Philosophy of Sciences Research Centre of the University of Lisbon.
  Duration: 36 months beginning in 2014.
• Medicine and Criminal Justice – I (mental health, changes in behaviour and health technologies, problems of bioethics)
  To be carried out by: Group I
  Method: Organisation of postgraduate courses and a PhD course in conjunction with the Faculty of Medicine of the University of Lisbon.
  Duration: 60 months beginning in 2014.
